Cruise line accuses Fort Lauderdale hotel property of contract breach

Contract 05

FORT LAUDERDALE — A cruise line is suing a Marriott hotel property in Fort Lauderdale, alleging breach of contract.

Caribbean Cruise Line Inc. filed a complaint Sept. 21 in Broward Circuit Court against TPG Ft. Lauderdale LLC, doing business as Marriott Fort Lauderdale North,  alleging the defendant breached its duty of good faith and fair dealing.

According to the complaint, in September 2012, Caribbean Cruise Line  suffered damages after entering into a valid agreement regarding the use of hotel rooms and meals. The suit says the defendant had wrongfully accepted meal/food vouchers from Caribbean's guests in exchange for sodas or alcoholic beverages, instead of charging guests for beverages, excess amounts, service charges and sales taxes.

The plaintiff alleges the defendant allowed guests to use meal vouchers for meals and beverages that were not applicable, and charged service charges and sales tax to the plaintiff in breach of the implied contract, resulting in gross overbilling.

Caribbean Cruise Line seeks trial by jury, damages, interest, attorney fees, court costs, and all relief the court deems just. It is represented by attorney Geoffrey A. Pette of Fort Lauderdale.
