Orange County sheriff, officers accused of negligence over alleged false arrest

An individual is suing Orange County Sheriff Jerry Demings, Joe Farias-Rios, Ray Monreal, Nephrateri Garnett and Cedric Broomfield for alleged battery and negligence.

ORLANDO — An individual is suing Orange County Sheriff Jerry Demings, Joe Farias-Rios, Ray Monreal, Nephrateri Garnett and Cedric Broomfield for alleged battery and negligence.

Timothy Keller filed a complaint on Aug. 3 in the Orange County Circuit Court, alleging that the defendants breached their duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that he experienced symptoms of decreased responsiveness and syncope while operating of a vehicle on July 8, 2016. Although his partner safely maneuvered the vehicle into the median and they allegedly refused further medical assistance, the defendants allegedly restrained Keller, took him to the ground and handcuffed him. As a result, the plaintiff allegedly was injured, suffered abrasions, a fractured foot, mental anguish, oppression, loss of earnings, loss of dignity, loss of liberty and damage to his reputation. 

The plaintiff holds the defendants responsible for allegedly attempting to arrest him under a mistaken belief and without legal justification, failing to conduct a reasonable investigation and allegedly depriving him of his liberty against his will and without evidence of a criminal act.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, taxable costs and any further relief the court deems just. He is represented by J. Scott Murphy of Paul & Perkins PA in Orlando.
