ORLANDO — A married couple is suing Future Foam Carpet Cushion Co. for alleged negligence.

Calixto Delgado and Lizette Cordero filed a complaint on July 21 in the Orange County Circuit Court, alleging that the defendant failed to follow applicable safety guidelines and procedures.

According to the complaint, the plaintiffs allege that Calixto Delgado was dispatched by his employer to defendant's facility on Dec. 20, 2016 to pick up a sealed trailer for delivery. But as soon as he released the lock mechanism to unload the goods, the rear doors allegedly flew open from the rolls of insulation that shifted and spilled out of the trailer onto Delgado, who allegedly was knocked to the ground. As a result, Delgado allegedly suffered bodily injury, disability, mental anguish and the aggravation of a pre-existing condition. His claims that she suffered loss of consortium from her injured husband. 

The plaintiffs hold the defendant responsible for allegedly failing to properly load and secure the cargo to avoid shifting, properly train its employees on the correct manner of securing the cargo, fully comply with federal or state laws on the securement of cargo and for allegedly failing to warn Delgado of the overloaded and/or unsecured trailer.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages that exceed $15,000 plus interest, costs and attorney's fees. They are represented by Chadwick J. Lawrence of the Lawrence Law Firm in Kissimmee.
