ORLANDO — A creditor is suing Jose Garcia, an individual, citing alleged unjust enrichment.
Sterling Jewelers Inc. d/b/a Jared Galleria of Jewelry filed a complaint on July 5 in the Orange County Circuit Court, alleging that the defendant breached his duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that it suffered monetary damages from having established a credit account in the defendant's name. Although the plaintiff allegedly has made numerous demands for payment, the defendant allegedly has not paid the full amount.
The plaintiff holds the defendant responsible for allegedly receiving and retaining the benefit and services bestowed by the plaintiff, and for allegedly forcing the plaintiff to retain and pay for legal counsel.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in the sum of $5,773.49 with court costs and any further relief the court deems just.
