Homeowner claims he is in doubt of rights under Omega Insurance policy, seeks relief

ORLANDO – The owner of an Orlando property on Autumnvale Drive alleges his insurer has failed to take action on his claim for damages to his kitchen.

Gonzalo Canete Romero filed a complaint on July 3 in the 9th Judicial Circuit Court of Florida - Orange County against Omega Insurance Co. seeking declaratory relief.

According to the complaint, the plaintiff alleges that on Aug. 18, 2015, he suffered a covered loss under his insurance policy with the defendant when his property was severely damaged as a result of kitchen plumbing failure. He alleges he submitted a claim to the defendant, but the defendant has neither denied nor indemnified him without 90 days of submission as required by Florida law. He alleges he is in doubt of his rights and interest under the policy.

The plaintiff requests a trial by jury and seeks declaration of the coverage existing for the loss, attorney’s fees, costs of action, and further relief as the court deems proper. He is represented by David G. Hassan of Mena Law Firm in Miami.
