Town of Eatonville named in suit by woman who alleges she was injured by sidewalk

ORLANDO – A woman alleges she was injured because of the conditions of the sidewalk in front of the Eatonville Town Hall and is seeking more than $15,000 in damages.

Helena D. Gibbs filed a complaint on June 28 in the 9th Judicial Circuit Court of Florida - Orange County against town of Eatonville alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 21, 2015, she was lawfully on defendant's property when she tripped on an uneven surface in front of the town hall and fell forcefully to the ground, sustaining severe bodily injury, resulting in pain and suffering, disability, scarring, mental anguish, and aggravation of a previously existing conditions. 

The plaintiff holds town of Eatonville responsible because the defendant allegedly failed to adequately inspect and maintain the walkway and failed to warn plaintiff of the danger of the uneven surface.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000, plus interest and costs. She is represented by Karl W. Labertew of Dan Newlin & Partners in Orlando.
