WEST PALM BEACH – A Delray Beach business is alleged to have discriminated against disabled patrons because of architectural barriers on the property.

Janet Hoyt filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against Nature of Marble LLC, doing business as Nature of Marble, alleging that the property owner violated the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on Jan. 31, she visited the defendant's business and was denied the benefits of services, programs and activities at the defendant’s buildings and its facilities. The plaintiff holds Nature of Marble LLC responsible because the defendant allegedly does not have an accessible restroom.

The plaintiff seeks an order from the court for the defendant to alter its premises, all costs, other expenses, and further relief as the court may deem necessary. She is represented by Jason S. Weiss and Zachary W. Smith of Weiss Law Group PA in Coral Springs.
