FORT LAUDERDALE – A Miami-Dade County consumer alleges a debt collector tried to collect a debt he previously paid.
Javier A. Castellanos filed a complaint on Feb. 15 in the U.S. District Court for the Southern District of Florida against Portfolio Recovery Associates LLC alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that he settled a debt with the defendant and paid the account in full in January. The plaintiff holds Portfolio Recovery Associates LLC responsible because the defendant allegedly sent a collection letter directly to him later that month in violation of the FDCPA and the FCCPA.
The plaintiff requests a trial by jury and seeks damages, all legal fees, enjoin the defendant, all legal fees and any other relief as the court deems just. He is represented by Joel D. Lucoff of JDL Law PA in Miramar.
