MIAMI – A Miami-Dade County employer is accused of not paying a former mechanic proper overtime compensation.
Roger Javier Carballo Montes filed a complaint on behalf of all others similarly situated on Jan. 23 in the U.S. District Court for the Southern District of Florida against Lorenzo Auto Services Corp. and Francisco J. Jimenez alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week
without being paid any overtime compensation during his employment from June 2008 to January. The plaintiff holds Lorenzo Auto Services Corp., Francisco J. Jimenez responsible because the defendants allegedly failed to pay the plaintiff any overtime premium at a rate of time-and-one-half for working more than 40 hours.
The plaintiff requests a trial by jury and seeks double damages, all overtime wages, all legal fees plus interest, and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
