MIAMI – A man formerly employed as a tile installer and laborer alleges he was not properly compensated for all hours worked and was terminated in retaliation for his complaints.
Eddie Leonard Simmons filed a complaint on Dec. 12 in the U.S. District Court for the Southern District of Florida against B & B Contracting Inc., Robert H. Bazzano, Walter Beaton and Frankie Alameda citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime compensation and was terminated when he complained of not receiving overtime pay. The plaintiff holds B & B Contracting Inc., Bazzano, Beaton and Alameda responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums of time-and-one-half for working more than 40 hours per week.
The plaintiff requests a trial by jury and seeks back and front pay, lost benefits, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
