FORT MYERS — A Lee County man is suing Prudential Insurance, alleging breach of contract.
Spencer D. Bradley filed a lawsuit Nov. 30 in Lee County Circuit Court against The Prudential Insurance Company of America, alleging the defendant breached its duty of good faith and fair dealing.
According to the complaint, Bradley was designated by the insured, Jeffrey D. Bradley, as his beneficiary. The suit says Jeffrey Bradley died July 28.
The lawsuit states because an insurance policy under Veteran's Group Life Insurance remains active, Spencer Bradley submitted a claim for death benefits pursuant to the policy. However, the suit says, Prudential has failed and refused to pay benefits to which Bradley is entitled.
The lawsuit says Bradley suffered monetary damages, including loss of benefit payment and the plaintiff was forced to retain and pay for legal fees.
The plaintiff alleges Prudential Insurance failed to discharge its duties in respect to claims processing in the interests of Bradley, and failed to fulfill its obligations to the beneficiary of the death benefit under the policy.
Bradley seeks trial by jury, judgment for damages plus interest, court costs and attorney's fees. He is represented by attorney Joshua D. Molandes of Morgan & Morgan PA in Fort Myers.
