Sream Inc. claims LB Smoke Shop sells counterfeit RooR water pipes

MIAMI – A Miami-Dade County business is accused of selling counterfeit water pipes.

Sream Inc. filed a complaint on Nov. 28 in the U.S. District Court for the Southern District of Florida against LB Smoke Shop Inc. trademark infringement.

According to the complaint, the plaintiff alleges that since August 2013, it has been the exclusive licensee of the RooR Marks in the United States. The plaintiff alleges the defendant is selling counterfeit products of inferior quality bearing the identical RooR marks without consent or license from plaintiff.

The plaintiff holds LB Smoke Shop Inc. responsible because the defendant allegedly could cause confusion among consumers by using the same marks as plaintiff's distinctive marks.

The plaintiff seeks judgment against the defendant, statutory damages of up to $2 million per mark, tinjunctive relief, attorney's fees and costs, and any further relief the court deems just. It is represented by Jamie Alan Sasson of The Ticktin Law Group PLLC in Deerfield Beach.
