MIAMI — A wellness center is suing Olympus Medical Plan LLC, alleging violation of telephone harassment statutes.
Moyal Wellness Center LLC filed a complaint on Nov. 29 in the U.S. District Court for the Southern District of Florida Miami Division against Olympus Medical Plan LLC, alleging that the Florida company sent unsolicited fax advertisement to the plaintiff.
According to the complaint, the plaintiff alleges that in October, it suffered damages from receiving an unsolicited fax advertisement. The plaintiff holds Olympus Medical Plan LLC responsible because the defendant allegedly sent the advertisement to the plaintiff without its consent.
The plaintiff requests a trial by jury and seeks actual damages of $500, treble damages, enjoin the defendant, all legal fees and any other relief as this court deems just.
