FORT LAUDERDALE – A Broward County man alleges a debt collector is calling him in an attempt to collect a debt owed by a third party.
Yazan Saleh filed a complaint on Nov. 21 in the U.S. District Court for the Southern District of Florida against Enhanced Recovery Co. LLC alleging violation of the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that in July, he started receiving incessant calls from the defendant in an attempt to locate and/or collect a debt from an individual other than him. Despite being told by the plaintiff that he was not the third party and to cease calling, the defendant allegedly continued its barrage of calls.
The plaintiff holds Enhanced Recovery Co. LLC responsible because the defendant allegedly called and left messages to plaintiff with such frequency meant to abuse or harass, unlawfully utilized an automatic dialer and automated voice, and contacted plaintiff without prior express consent.
The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages of $500 for each TCPA violation, treble damages of $1,500 for each TCPA violation, actual damages, injunction to cease all calls from the defendant, costs, attorneys' fees and other relief that the court deems just.
