American Recycling Corp. allegedly terminated man in retaliation over pay complaints

TAMPA – A former employee for a Tampa recycling company alleges he was terminated for complaining about not being properly compensated for overtime work.

Luis Alberto Diaz filed a complaint on Nov. 16 in the Tampa Division for the Middle District of Florida against American Recycling Corp. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation from January to September. The plaintiff holds American Recycling Corp. responsible because the defendant allegedly failed to pay the plaintiff any overtime premiums for working more than 40 hours and then terminated in him retaliation for complaining about the pay practices.

The plaintiff requests a trial by jury and seeks compensation for lost wages, benefits and other remuneration, compensatory damages, and any other relief as this court deems just. He is represented by Christopher J. Saba of Wenzel Fenton Cabassa PA in Tampa.
