Dr. Sears Center for Health & Wellness Inc. employee alleges he was not paid overtime wages

MIAMI – An employee alleges a Royal Palm Beach health center did not properly compensate him for overtime hours worked.

Joseph Radich filed a complaint on Oct. 11 in the U.S. District Court for the Southern District of Florida against Dr. Sears Center for Health & Wellness Inc. and Al C. Sears alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without getting paid any overtime compensation. The plaintiff holds Dr. Sears Center for Health & Wellness Inc. and Sears responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half for the extra hours the plaintiff worked.

The plaintiff requests a trial by jury and seeks all damages and relief, liquidated damages, interest, all legal fees and any other relief the court deems just. He is represented by Chad Levy of Law Offices of Levy & Levy PA in Fort Lauderdale.
