Former Simon's Sportswear employee alleges he was not paid overtime

MIAMI – A former sales associate alleges an athlete apparel retailer in based in Hallandale did not pay him overtime.

Clarence Curry filed a complaint on behalf of others similarly situated on Oct. 8, in the U.S. District Court for the Southern District of Florida against NNS Trading Inc., doing business as Simon's Sportswear; Dani Shimon; and Ilan Shimon alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime compensation from July 2014 to December 2015. The plaintiff holds NNS Trading Inc., Dani Shimon and Ilan Shimon responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half to plaintiff for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks payment of all overtime wages, liquidated damages, all legal fees and interest plus any other relief the court deems just. He is represented by Keith M. Stern and Hazel Solis Rojas of Law Office of Keith M. Stern PA in Miami.
