MIAMI — A former cruise ship passenger has filed suit against the cruise line and its promoter for allegedly failing to take measures to prevent injuries and negligence after she fell.
Carole Barbarite filed a complaint Sept. 29 in U.S. District Court for the Southern District of Florida, Miami Division, against Celebrity Cruises Inc. and Tura Turizm, alleging that they failed to properly assist the plaintiff during the shore excursion.
According to the complaint, the plaintiff alleges that on Oct. 21, 2015, she sustained physical injuries including a comminuted femur fracture of her left leg. The plaintiff holds Celebrity Cruises Inc., and Tura Turizm responsible because the defendants allegedly failed to implement a care plan for their passengers while participating in the shore excursion.
The plaintiff requests a trial by jury and seeks compensatory damages, interest, all legal fees and any other relief as the court deems appropriate. She is represented by Carol L. Finklehoffe and Jason R. Margulies of Lipcon, Margulies, Alsina & Winkleman P.A. in Miami.
