Room attendant alleges she was retaliated against by Swamiji Management Inc.

MIAMI – A room attendant alleges she was terminated in retaliation for complaining about not being paid overtime.

Yulith Contreras filed a complaint on behalf of other similarly situated individuals on Sept. 27 in the U.S. District Court for the Southern District of Florida, Miami Division against Swamiji Management Inc., doing business as Best Western Windsor Inn., citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between June and August, she worked for more than 40 hours without being paid any overtime compensation and was not paid for two days of work. The plaintiff holds Swamiji Management Inc. responsible because the defendants allegedly failed to pay plaintiff at a rate of time-and-one-half for hours worked that exceeded 40 hours per week and also discharged in retaliation for complaining about not being paid overtime.

The plaintiff requests a trial by jury and seeks all back wages, liquidated damages, reinstatement and promotion, front wage and any other relief as the court deems just. She is represented by R. Martin Saenz of Saenz & Anderson PLLC in Aventura.
