Americollect Inc. accused of not marking disputed debt on man's credit report

MIAMI – A North Miami man alleges a debt collector violated federal law regarding a reported debt on his credit report.

Ralph Higgens filed a complaint on Sept. 20 in the U.S. District Court for the Southern District of Florida against Americollect Inc. citing the Fair Debt Collections Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he dispute an alleged debt with the defendant by letter in January. The plaintiff holds Americollect Inc. responsible because the defendant allegedly failed to mark plaintiff's credit account or tag it as "disputed by consumer" despite receiving plaintiff's dispute letter as required by the FDCPA.

The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. He is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
