Woman claims The Hartford Life and Accident Insurance Co. wrongfully denied her benefits

GAINESVILLE — A woman has filed suit against an insurance company for allegedly denying her long-term disability payments.

Virginia Adams filed a complaint Sept. 14 in U.S. District Court for the Northern District of Florida against The Hartford Life and Accident Insurance Co., alleging that the plan administrator violated Employe Retiree Income Security Act through denial of her long-term disability benefits.

According to the complaint, the plaintiff alleges that on Aug. 26, 2010, she became disabled and stopped working due to lumbar and cervical spine discopathy. Although she supposedly was paid long-term disability benefits from Feb. 25, 2011, through Feb. 25, 2016, and remains to be disabled as defined by the policy, her future claims were denied starting June 30, 2016, which allegedly caused damages to the plaintiff including legal expenses. 

The plaintiff holds The Hartford Life and Accident Insurance Co. responsible because the defendant allegedly caused the plaintiff to retain and pay legal counsel for representation and failed to pay benefits pursuant to the terms of the plan.

The plaintiff requests a trial by jury and seeks an order granting relief from the defendant for benefits due, interest, costs of litigation and attorney's fees. She is represented by Nancy L. Cavey of Law Offices of Nancy L. Cavey in St. Petersburg.
