Subway franchise employee alleges she wasn't paid overtime, paychecks didn't clear

MIAMI – A cashier and sandwich maker for a Subway franchise alleges her employer did not fairly compensate her for all hours worked.

Rowshan Salim filed a complaint on Sept. 5 in the U.S. District Court for the Southern District of Florida against the Salma International Inc., Amin R. Ismail and Mohammed Rafique Ismail citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours without being paid any overtime compensation or paid a full and proper minimum wage. She also alleges several paychecks did not clear due to insufficient funds in the defendants' bank account. The plaintiff holds Salma International Inc., Amin R. Ismail and Mohammed Rafique Ismail responsible because the defendants allegedly failed to pay any overtime premium at a rate of time-and-one-half to the plaintiff for hours worked that exceeds 40 per week.

The plaintiff seeks judgment against the defendant, all legal fees and any other relief as the court deems just. She is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
