Oversees corporation claims allegedly trademark infringement against Florida company's racing go-kart tires

MIAMI — An overseas company has filed suit against a Florida company for alleged trademark infringement on its racing go-kart tires. 

MG Industria E Comercio S.A. filed a complaint on Aug. 16 in U.S. District Court for the Southern District of Florida against W.R. International Business Inc., alleging that the Florida corporation used the plaintiff's MG Tires trademark, which allegedly causes confusion to consumers.

According to the complaint, the plaintiff alleges that MG Industria E Comercio S.A. suffered damages to its business. The plaintiff holds W.R. International Business Inc. responsible because the defendant allegedly claimed ownership of the MG Tires trademark and reportedly removed its content from the website only to replace it with a competitor's website.

The plaintiff requests a trial by jury and seeks order the defendant to cease and desist all actions of unfair competition, damages in the amount of $2,000,000, all legal fees and any other relief as the court deems appropriate. It is represented by Jeffrey M. Garber of Ciklin Lubitz & O'Connell in West Palm Beach.
