Consumer files suit against HMC Group over alleged debt on credit report

MIAMI – A Pembroke Pines consumer has filed suit against an Ohio-based debt collector over claims it reported an alleged disputed debt to a credit agency.

Wilner Marcelin filed a complaint on Aug. 8 in the U.S. District Court for the Southern District of Florida against HMC Group Inc. alleging violation of the Fair Debt Collections Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that between 2015 and 2016, he sustained damages to his credit account when the defendant reported an alleged debt to a credit reporting agency after the plaintiff sent a dispute letter. The plaintiff holds HMC Group Inc. responsible because the defendant allegedly did not remove the credit amount on plaintiff's credit report or tag it as "disputed by consumer."

The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. He is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
