Man claims debt collectors filed suit against him over debt that wasn't his

MIAMI – A Broward County man alleges debt collectors improperly took legal action against him over a debt that did not belong to him.

Jackie R. Cox filed a complaint on July 15 in the U.S. District Court for the Southern District of Florida against Pollack & Rosen PA and Midland Funding LLC alleging violation of the Fair Debt Collection Practices Act and other counts.

According to the complaint, the plaintiff alleges that he suffered damages as a result of a state court being filed against him by the defendants regarding a debt for HSBC that is not his. The plaintiff states he has never had an account with HSBC. The plaintiff holds Pollack and Rosen PA and Midland Funding LLC responsible because the defendants represented to the court that a female cousin accepted the summons at the plaintiff's residence, and the plaintiff states he does not have any female cousins and lives alone; served a dissolved writ of garnishment to his employer, and improperly obtained a judgment against him.

The plaintiff requests a trial by jury and seeks damages, all legal fees and any other relief as the court deems just. He is represented by Donald A. Yarbrough in Fort Lauderdale.
