TAMPA – An Arizona company is facing allegations from a Polk County woman of telephone harassment.
Theresa Miller filed a complaint on July 11 in the U.S. District Court for the Middle District of Florida against Drivetime Car Sales Co. LLC alleging violation of the Federal Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that between 2014 and 2015, she was called several times on her cellular telephone by the defendant in an attempt to collect an alleged debt. The plaintiff holds Drivetime Car Sales Co. LLC responsible because the defendant allegedly kept on calling plaintiff despite her requests for the defendant to stop calling her.
The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, treble damages, all legal fees and interest, and any other relief as the court deems just. She is represented by Jared M. Lee of Morgan & Morgan, Tampa PA in Orlando.
