Coldwell Banker Residential Real Estate accused of using photos without permission

WEST PALM BEACH – A photographer alleges his copyrighted photos of a Florida country club were used by a real estate service without his permission.

Affordable Aerial Photography Inc. filed a complaint on July 7 in the U.S. District Court for the Southern District of Florida against Coldwell Banker Residential Real Estate LLC, doing business as Coldwell Banker; Elvira Galper; and Maura Slaughter citing copyright infringement.

According to the complaint, the plaintiff alleges that Affordable Aerial Photography Inc. suffered damages as a result of its works of the Bocaire Country Club in Boca Raton by photographer/founder Robert Stevens being used without its permission by the defendants. The plaintiff holds Coldwell Banker Residential Real Estate LLC, Elvira Galper, and Maura Slaughter responsible because the defendants allegedly used plaintiff's photos without permission to promote their sale of the property.

The plaintiff requests a trial by jury and seeks permanently enjoin the defendants, for the defendants to pay actual damages and profits, statutory damages, all legal fees and any other relief as the court deems just.
