Man claims Exxon gas station isn't accessible to disabled

MIAMI – An individual alleges that the property owner of a gas station failed to make the facility accessible to disabled persons.

Emilio Pinero filed a complaint on May 31 in the U.S. District Court for the Southern District of Florida against Danny A. Flores, alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he wanted and attempted to access an Exxon gas station in Miami to enjoy the goods and services offered but was unable to do so because of physical barriers that limit the accessibility of disabled individuals. The plaintiff holds Flores responsible because the property allegedly does not have an accessible path from the parking area to the convenience store and to the sidewalk, and the appropriate parking space has an excessive slope.

The plaintiff seeks permanent injunction against the defendant, an order to make the facility readily accessible to plaintiff and other people with disabilities, and all legal fees. He is represented by Lauren Wassenberg of Lauren Wassenberg ESQ in Boca Raton.
