Pool cleaner alleges The Business Man owes him more than 200 hours of overtime pay

FORT LAUDERDALE – A pool cleaner alleges he was misclassified as a salaried employee and is owed overtime wages.

Frantz Lassegue filed a complaint on May 11 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against The Business Man Inc., doing business as Cliff's Pools & Patios, alleging that the employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he regularly worked for more than 40 hours per workweek but was not properly compensated. The plaintiff holds The Business Man Inc. responsible because the defendant allegedly paid him $575 per week regardless of how many hours he actually worked, failed to compensate him at a rate of time-and-one-half of his regular rate for all hours worked in excess of 40 per week and failed to maintain proper time records. He alleges he is owed 218 hours of overtime pay.

The plaintiff requests a trial by jury and seeks declaration that defendant's acts violated the provisions of FLSA, compensation for unpaid wages, liquidated damages, attorney's fees and costs, prejudgment interest and any other relief that the court deems just and proper.
