Consumer claims Morse Shores is not ADA compliant

ORLANDO – A Broward County resident claims a Fort Myers business is not readily accessible to the disabled.

Patricia Kennedy filed a complaint on May 12 in the U.S. District Court for the Middle District of Florida against J.B. Baldwin, trustee, Quality Self Storage VI Trust alleging that the Morse Shores owner allegedly failed to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff alleges that she visited the defendants' property and encountered barriers which discriminate against her, causing her to suffer direct and indirect injury, frustration and humiliation. The plaintiff holds J.B. Baldwin, trustee, Quality Self Storage VI Trust responsible because the defendants allegedly failed to maintain its features to ensure that they are readily accessible and usable by the disabled, failed to provide accessible route connecting the disabled parking spaces with all the goods, services and facilities of the property and failed to provide compliant restrooms.

The plaintiff requests a trial by jury and seeks declaration that the defendants' property is in violation of ADA, an order for defendants to make all readily achievable alterations to the facility, attorney’s fees, costs and litigation expenses and for such other relief as the court deems just and proper. She is represented by Thomas B. Bacon of Thomas B. Bacon PA in Fort Lauderdale.
