MIAMI – A luxury goods manufacturer several online sellers alleging they are selling counterfeit products.
Chanel Inc. filed a complaint on May 3 in the U.S. District Court for the Southern District of Florida against the AE Best, alice hu, Aymar.Fashion World, Belle Mall, et al. citing alleged trademark counterfeiting and infringement, false designation of origin and common law unfair competition.
According to the complaint, the plaintiff alleges that it has suffered and will continue to suffer irreparable injury and damages unless and until a decision is rendered enjoining defendants from further infringing Chanel trademarks. The plaintiff holds the defendants responsible because the defendants allegedly wrongfully reproduced, promoted, advertised, distributed, sold and offered for sale goods bearing counterfeits and confusingly similar imitations of Chanel’s trademarks.
The plaintiff requests a trial by jury and seeks temporary, preliminary and permanent injunctions enjoining defendants from infringing Chanel’s marks; an order requiring the seller IDs used by defendants be disabled; an order requiring defendants to account to and pay for all profits resulting from defendants' counterfeiting; attorneys’ fees and costs; prejudgment and post-judgment interest; and for any further relief as the court may deem just and proper.
