Photographer alleges photos of yacht were used without permission

MIAMI – A professional photographer has filed suit against a co-owner of a yacht alleging unauthorized photo use.

Rolando Diaz filed a complaint on April 11 in the U.S. District Court for the Southern District of Florida, Miami Division against Alexander P. Coleman over claims of copyright infringement.

According to the complaint, the plaintiff alleges that he photographed the yacht the Octopussy, which Coleman co-owns, which have been registered with the U.S Copyright Office. The plaintiff holds Coleman responsible because the defendant allegedly committed copyright infringement by publishing his images of the Octopussy on the internet and in brochures in connection with the defendant's charter business. The suit states Coleman illegally profited from his infringing activities.

The plaintiff requests a trial by jury and seeks an order prohibiting defendant from further use of his photographs, compensation for statutory damages, reasonable attorney’s fees and costs and for such other and further relief as is just. He is represented by John B. Ostrow of John B. Ostrow PA in Miami.
