ORLANDO – A water technician is suing his Brevard County employer citing alleging unpaid wages.
James Liberatore filed a complaint on April 6 in the U.S. District Court for the Middle District of Florida, Orlando Division against AAA Discount Water Outlet - The Waterman Inc. alleging that the employer violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that from January 2013 to the present date, he has not received any overtime compensation for all extra hours worked and has suffered damages plus incurring attorneys' fees and costs. The plaintiff holds AAA Discount Water Outlet - The Waterman Inc. responsible because the defendant allegedly refused to pay him at a rate of time-and-one-half of his regular rate for each hour worked in excess of 40 per work week and failed to keep accurate time records as required by law.
The plaintiff requests a trial by jury and seeks declaratory relief, compensation for unpaid overtime wages, liquidated damages, attorneys' fees and costs and any further relief that the court may determine to be just and appropriate.
