MIAMI – A former Galliano Marine Service employee alleges his long-term disability benefits were wrongfully terminated.
Eric Johnson filed a complaint on April 4 in the U.S. District Court for the Southern District of Florida against Hartford Life and Accident Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that from Oct. 30, 2015, to the present date, he has not received his benefits due under the long-term disability plan and has suffered damages for loss of such benefits. The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly wrongfully denied to continue paying his benefits after approving and paying them for two years and failed to properly investigate the merits of his disability claim.
The plaintiff requests a trial by jury and seeks an order declaring that he is entitled to immediate reinstatement to the plan, payment for disability benefits due, attorneys’ fees and costs, prejudgment and post-judgment interest and for such other and further relief as the court may deem just and proper.
