Pinellas woman alleges her disability benefits were wrongfully terminated

TAMPA – A registered nurse alleges her long-term disability benefits were wrongfully terminated.

Michelle Goldstein filed a complaint on April 4 in the Tampa Division of the Middle District of Florida against The Lincoln National Life Insurance Co. alleging that the claims administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she is disabled and began receiving benefits from the defendant in August 2014. She alleges they were terminated a year later. The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly breached the terms of the long-term disability policy, failed to discharge its duties in respect to discretionary claims and relied only on the views of its own medical consultants.

The plaintiff requests a trial by jury, unpaid benefits plus interest and any other relief as the court may deem just and proper. She is represented by Carter E. Meader and Edward Philip Dabdoub of Wagar Dabdoub PA in Coral Gables.
