TAMPA – A Lee County woman alleges that a debt collector has called her numerous times over a debt belonging to her former husband.
Jennifer Bonilla filed a complaint on March 28 in the Tampa Division for the Middle District of Florida against Crescent Bank & Trust Co. alleging that the collection agency violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that she has received approximately 60 intrusive and unwanted telephone calls from the defendant since July 2014. The plaintiff holds Crescent Bank & Trust Co. responsible because the defendant allegedly called her in an attempt to collect an alleged debt despite its knowledge that the actual debtor was her former husband, Edward Bonilla. Despite her demand to defendant to cease calling her, she alleges the defendant repeatedly called her using an automatic telephone dialing system and/or pre-recorded or artificial voice messages.
The plaintiff requests a trial by jury and seeks compensation for statutory, punitive and actual damages, attorney's fees, costs and interest, enjoinder from further violations of these parts and any further relief that the court may deem just and proper.
