Disabled employee sues plan administrator

JACKSONVILLE – A Nassau County woman alleges her insurance company wrongfully denied her benefits.

Heidi S. Nicol filed a complaint on March 29 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Hartford Life and Accident Insurance Co. alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that the defendant wrongfully denied her claim for long-term disability benefits and waiver of premium benefits.

The plaintiff requests a trial by jury and seeks judgment against defendant for payment of benefits and waiver of premiums due and owing under the plan, attorneys' fees, costs and interest. She is represented by Thomas M. Farrell IV of Farrell Disability Law in Jacksonville.
