Melbourne resident accuses Liberty Life Assurance Co. of Boston of denial of benefits

ORLANDO – A former Cadence Design Systems employee alleges he was wrongfully denied long-term disability benefits.

Tauni Shuck filed a complaint on March 22 in the U.S. District Court for the Middle District of Florida, Orlando Division against Liberty Life Assurance Co. of Boston, alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he suffered a stroke in 2014. The suit states he was approved for short-term disability but denied long-term disability benefits. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly wrongfully denied to pay his benefits under the plan, discounted the medical opinions of his physicians and instead relied on their consultants' reports without examining him.

The plaintiff requests a trial by jury and seeks a declaratory relief, a finding that he is entitled to all past due short-term and long-term disability benefits, prejudgment interest, attorney's fees and costs and any further relief as may be deemed just and proper by the court. He is represented by Keith J. Ganobsik of Marc Whitehead & Associates in Pinellas Park.
