MIAMI – A former employee is suing a dissolved Florida convenience store alleging that she was not paid overtime wages for the average of 73 hours she worked per week.
Elizabeth Fljankovic filed a complaint on March 22 in the U.S. District Court for the Southern District of Florida against Sinisa Fljankovic and Sunrise Oil Plantation LLC, alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between April 15, 2012, and June 14, 2014, she did not receive proper compensation for all hours worked during her employment. The plaintiff holds Sinisa Fljankovic and Sunrise Oil Plantation LLC responsible because the defendants allegedly willfully refused to properly compensate at the basic minimum wage for all work performed at time-and-one-half of her hourly rate for each hour worked in excess of 40 per work week and failed to maintain proper time records.
The plaintiff requests a trial by jury and seeks compensation for all damages, attorneys’ fees, costs and expenses and any further relief that the court may deem just and proper. She is represented by Michael I. Bernstein and Brian G. Winger of The Bernstein Law Firm in Miami.
