TAMPA – A construction employee has filed a class-action lawsuit against his former employers over allegations of unpaid wages.
Miguel Rafael filed a complaint on behalf of himself and others similarly situated on March 21 in the Tampa Division of the Middle District of Florida against Legomatic Construction LLC and ZMG Construction Inc. alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he has not received proper overtime compensation. The plaintiff holds Legomatic Construction LLC and ZMG Construction Inc. responsible because the defendants allegedly shaved hours from his time record, failed to pay him time-and-one-half of his hourly rate for all hours worked in excess of 40 in a work week and failed to maintain proper time records.
The plaintiff requests a trial by jury and seeks compensation in an equal amount to lost wages, liquidated damages, attorney's fees and costs and any further relief that the court may deem just and proper. He is represented by W. John Gadd of Mazaheri Gadd PA in Clearwater.
