In a dramatic legal filing, a Florida resident has taken on one of the largest retail giants in the world over an alleged slip-and-fall incident that resulted in serious injuries. Andrea Gorgonio filed a complaint against Wal-Mart Stores East, LP in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on October 14, 2024. The lawsuit accuses Walmart of negligence after Gorgonio reportedly slipped on a foreign substance at one of its stores.

The incident occurred on July 25, 2023, when Andrea Gorgonio was shopping as a business invitee at the Walmart Supercenter located at 101 N Congress Ave, Lake Park, FL. According to the complaint, she stepped on an unidentified transitory substance in an aisle and fell to the ground. This fall allegedly caused her significant personal injuries. The plaintiff asserts that Walmart failed to maintain safe premises and did not uphold its duty to ensure that areas frequented by customers were free from hazards.

Gorgonio's lawsuit outlines multiple allegations against Walmart. She claims that the company was negligent in maintaining or adequately inspecting the floors for dangerous conditions and failed to warn her about potential risks. The complaint further alleges that Walmart did not have sufficient staff assigned to monitor and maintain safety standards within their store and failed to follow corporate policies designed to prevent such accidents. "Defendant breached its duties by negligently failing to inspect or adequately warn the Plaintiff of danger," states the document.

Andrea Gorgonio is seeking damages exceeding $50,000 for pain and suffering, medical expenses, loss of earnings, and other related costs resulting from her injuries. She demands a jury trial for all issues so triable as part of her pursuit for justice against Walmart.
