MIAMI – A bartender for a Hallandale restaurant alleges she was not paid overtime or minimum wages.
Sophie Gagne filed a class-action lawsuit on behalf of all others similarly situated on March 18 in the U.S. District Court for the Southern District of Florida against BA Sor Inc., doing business as Nando Restaurant, and Fernando Sorrentino, alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that she did not receive at least the minimum wage rate for all hours she worked and did not receive any compensation for all hours she worked in excess of 40 per week. The plaintiff holds Nando Restaurant and Sorrentino responsible because the defendants allegedly failed to maintain proper time records and willfully failed to pay the minimum wages and overtime premiums.
The plaintiff requests a trial by jury and seeks payment of all unpaid wages, liquidated damages, attorneys’ fees and costs and for any relief, including prejudgment interest. She is represented by Keith M. Stern of Law Office of Keith M. Stern PA in Doral.
