Man blames Disney Cruise Line for loss of thumb

ORLANDO – A Columbia man alleges that a cruise line's negligence led to the amputation of a finger.


Marco Fidel Acosta filed a complaint on March 16 in the U.S. District Court for the Middle District of Florida, Orlando Division against Magical Cruise Co., doing business as Disney Cruise Line, citing negligence.

According to the complaint, the plaintiff alleges that on April 26, 2015, he suffered bodily injury resulting in the amputation of his right thumb when the cabin door of the Disney Fantasy suddenly slammed on his hand. The plaintiff holds Disney Cruise Line responsible because the defendant's crew allegedly failed to warn him of the dangerous condition, failed to exercise reasonable care under the circumstances, failed to provide him immediate and adequate medical care and failed to provide safety devices on the hinges of the cabin doors.

The plaintiff seeks the following: compensation for all damages, interest and costs; and any further relief to which he may be justly entitled. He is represented by Jordan R. Wagner of Kibbey | Wagner in Stuart.
