Woman sues over termination of disability benefits

MIAMI — A woman is suing an insurance company that she says improperly terminated her long-term disability benefits.

Sandra DeBerry sued Hartford Life and Accident Insurance Company on Feb. 22 in U.S. District Court for the Southern District of Florida, alleging that the insurance company violated the Employee Retirement Income Security Act by terminating her long-term disability benefits.

The plaintiff alleges that, from January 9, 2015 to the present date, she has not received benefits due to her. The plaintiff holds Hartford Life and Accident Insurance Company responsible based on an allegation that the defendant allegedly failed to investigate the merits of her claim.

The plaintiff seeks the following: compensation for disability benefits due, attorneys’ fees and costs, pre-judgment and post-judgment interest; an order to immediately reinstatement her to the long-term disability plan; and any further relief that the court may deem just and proper. She is represented by Alexander A. Palamara and Gregory Michael Dell of Attorneys Dell & Schaefer Chartered in Hollywood.
