HICA Education Loan Corp. sues borrower alleging breach of loan agreement

FORT LAUDERDALE – A financing agency is suing a borrower for an allegedly unpaid loan balance.

HICA Education Loan Corp. filed a complaint on Feb. 24 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Ernesto A. Delvecchio, a borrower, citing breach of contract.

According to the complaint, the plaintiff alleges that Delvecchio signed a promissory note in 2001 for $101,832.65. The suit states that as of Feb. 16, $85,383.48 remained unpaid on the loan's principal.

The plaintiff seeks the following: compensation for actual damages, including unpaid principal, unpaid late charges, attorney’s fees and costs and any further relief that is just and equitable. It is represented by Ryan E. Davis of Winderweedle, Haines, Ward & Woodman PA in Orlando.
