Former tow company worker sues over pay allegations

FORT LAUDERDALE — A former employee is suing a towing company and its owners for allegedly violating minimum-wage and overtime-pay laws.

Alain Valdez filed a class-action suit against Gator Towing and Recovery Corp., Marlen Perez and Rigoberto Gomez on Feb. 19 in U.S. District Court for the Southern District of Florida Fort Lauderdale Division, alleging that the towing company intentionally violated the Fair Labor Standards Act, failed to pay the required minimum wage, failed to pay overtime and improperly withheld amounts from the plaintiff's wages.

According to the complaint, the plaintiff alleges that he worked for the defendants from Aug. 24, 2015 to Jan. 22, 2016, and he claims the defendants failed to maintain proper time records as mandated by law.

The plaintiff seeks the following: compensation for liquidated damages, plus interest, attorney’s fees and costs and any other monetary and equitable relief that the court may deem just and proper. He is represented by Miguel Armenteros of Perlman, Bajandas, Yevoli & Albright, PL in Coral Gables.
