MIAMI – A developer and surety company is suing a Broward County couple over breach of contract allegations.
Developers Surety and Indemnity Co. filed a complaint on Feb. 5 in the U.S. District Court for the Southern District of Florida against William Adams and Nancy Adams, citing breach of contract and unjust enrichment.
According to the complaint, the plaintiff alleges that it incurred losses and or expenses in the amount of $230,868.78 in connection with the issuance of five bonds. The plaintiff holds the defendants responsible because they allegedly failed to fulfill their contractual obligations per an indemnity agreement signed in May 2004. The suit states that Developers Surety and Indemnity Co. made indemnity demands upon the defendants in July 2011 and in January.
The plaintiff seeks the following: compensation for consequential damages, attorney’s fees and costs and any other further relief that the court may deem necessary. It is represented by Edward Etcheverry of Etcheverry Harrison LLP in Fort Lauderdale.
