O-B House allegedly failed to pay servers minimum wage or OT

FORT LAUDERDALE — Three former servers at O-B House are suing the restaurant over allegations of unpaid wages and overtime compensation.

Brittany Daubner, James Pintado and Ronald Coleman filed a lawsuit on Jan. 11 in the U.S. District Court for the Southern District of Florida against 333 Himmarshee LLC, doing business as O-B House; Rodney A. Ely; and Aaron Johnson, citing violations of the Fair Labor Standards Act (FLSA) and Article X of the Florida Constitution.

According to the complaint, the plaintiffs were employed as servers in a restaurant operated by the defendants. During their employment, the defendants allegedly failed to pay minimum wage or overtime compensation at the statutory rate of time and one-half. The plaintiffs claim the violations of the FLSA and Florida Constitution were willful and unlawful.

Daubner, Pintado and Coleman seek unpaid overtime compensation, unpaid minimum wages due, liquidated damages, attorney’s fees, pre- and post-judgment interest, and costs. They are represented by Peter Bober and Samara Robbins Bober of Bober & Bober, PA, in Hollywood.
