MIAMI – A traveler is suing an airline over injuries allegedly sustained during flight turbulence.
Xerxes Frechiani filed a complaint on Feb. 4 in the U.S. District Court for the Southern District of Florida, Miami Division against United Airlines Inc., citing breach of duty, failure to warn, negligence and violation of the Montreal Convention.
According to the complaint, the plaintiff alleges that, on March 7, 2014, he was violently tossed around the interior of the aircraft during a turbulence and suffered a torn ligament and torn rotator cuff. The plaintiff holds the defendant responsible because it allegedly failed to implement reasonable care for the safety of its passengers during the course of a flight.
The plaintiff seeks the following: compensation for damages sustained, prejudgment and post-judgment interest, attorneys’ fees and costs and any other relief that the court may deem just and proper.
