MIAMI — A former employee of Adam’s Concrete Services and KPP Concrete is suing for allegations of unpaid minimum wage and overtime compensation.
Felipe Espitia filed a lawsuit Dec. 21 in the U.S. District Court for the Southern District of Florida against Adam’s Concrete Services "LLC;" Karl’s Pumping & Placing Inc., doing business as KPP Concrete, doing business as Karl’s Pumping & Placing Inc. K.P.&P. Inc.; Karl Loeffler, Jeri Loeffler and Adam J. Loeffler, citing violations of the Fair Labor Standards Act (FLSA).
According to the complaint, the defendants were joint employers and/or individual managers of Espitia during his time of employment with the defendants. The plaintiff claims that he accepted employment, working as a pump operator, but was never paid minimum wage or overtime compensation for his work in violation of the FLSA. The records of date range, numbers of hours worked and compensation paid are allegedly in the possession of the defendants.
Espitia seeks unpaid minimum wages, time-and-a-half overtime pay, liquidated damages, interest, costs and attorneys’ fees. He is represented by Elliot Kozolchyk of Koz Law, PA, in Fort Lauderdale.
